The Energy Charter Treaty: a tool to combat climate change or an obstacle to the energy transition?

This debate will bring together international experts, policy-makers, trade and climate campaigners to discuss the potential threats and benefits of the Energy Charter Treaty.

The Energy Charter Treaty (ECT) entered into force two decades ago. Under this international treaty foreign investors can sue signatory governments at international arbitration tribunals over measures in the energy sector that they consider harmful to their profits.

Lawyers and arbitrators often argue that the investment protection chapter of the ECT could be an effective tool to combat climate change. It could help attract capital for clean energy, and can put pressure on States to maintain support for renewable energy projects.

On the other end of the spectrum, some academics and civil society claim that the ECT risks undermining the Paris Agreement as it protects investments in climate-wrecking fossil fuels and creates hurdles for actions to establish a just and socially fair energy transition.

The high level debate will bring together international experts, policy-makers, trade and climate campaigners to discuss the potential threats and benefits of the ECT.
