Standardization and patents: problems and policy options

Standardisation, standard-setting organisations and standard-essential patents have been the subject of considerable discussion and debate in both academic and policy circles. In this event which is co-organized with the Association for Competition Economics (ACE), Pierre Régibeau will present his recent study which assesses problems related to the standardization process and consider a number of policy options which might help alleviate these problems. His presentation will followed by panel discussion over the associated challenges and their potential solutions.

Specific questions to be discussed include:

  • How are technologies that are embedded in compatibility standards are chosen?
  • Under which conditions are they licensed to potential implementers?
  • How can we generate industry-wide standards through explicit cooperation between industry participants?
  • How clear and transparent are the rules and procedures on the inclusion of patented technologies?
  • What are the problems related to patent pools and how they can be solved?
  • What are the challenges in defining FRAND terms of licensing?
  • Are there specific policy options for providing more clarity in the definition?
  • How important problems are hold-up, hold-out and royalty stacking in the standardization process?
  • What are the challenges associated to standardization in the Internet of Things era?
