Collective redress in the EU: the state of play and next steps

The Committee on Legal Affairs (JURI) will hold a public hearing on ‘Collective redress in the EU: the state of play and next steps' in Brussels, on 21 February 2018, from 11-12:30. The hearing assembles Members of the European Parliament, Commission representatives, stakeholders and an academic with a view to discussing the recently published Commission report on the implementation of the 2013 Recommendation on common principles for injunctive and compensatory collective redress mechanisms in

the Member States as well as any follow-up actions to the report.

The Recommendation established principles which should be applicable in relation to violations of rights granted under Union law across all policy fields and in relation to both injunctive and compensatory relief. It follows from the Recommendation that all Member States should have collective redress systems at national level.

According to paragraph 41 of the EU 2013 Collective Redress recommendation, "the Commission should assess the implementation of the Recommendation on the basis of practical experience by 26 July 2017 at the latest. In this context, the Commission should in particular evaluate its impact on access to justice, on the right to obtain compensation, on the need to prevent abusive litigation and on the functioning of the single market, on SMEs, the competitiveness of the economy of the European Union and consumer trust.
